IR35 Forum – 10 May 2018

The IR35 Forum, made up of various industry representatives and HMRC, met again on 10 May 2018 and the minutes have now been released.
What was discussed?
Following concerns raised by Forum members in previous meetings, HMRC provided some statistics in relation to the Public Sector reforms introduced in April 2017. They stated that “compliance has improved as a result” and in that they estimate “an additional £410m of income tax and NICs have been remitted” since the reforms.
HMRC also acknowledged that many had expressed concerns about blanket assessments – whereby Public Sector bodies make an assessment of all contractors, rather than looking at individual contracts and circumstances. They confirmed that they have “worked to build a network of public bodies, provided help and guidance, encouraging consistency”.
CEST and the inclusion of Mutuality of Obligation (MOO)
Talk, as always, turned to CEST. HMRC provided statistics confirming that 750,000 assessments had been made using CEST to date demonstrating a high-level of use. HMRC also confirmed that “CEST has been tested using the core case law that people would expect”.
